Article 1: Definition of Services
- The New Otani Club Point Program is a service in which New Otani Club Points (hereinafter "Points") are awarded to members of the New Otani Club (hereinafter "Members") for uses of the group hotels within Japan operated by New Otani Co., Ltd. (hereinafter "New Otani") or the New Otani group (hereinafter "Group Hotels") applying to Article 2 hereof, and such Points can be redeemed for New Otani Club Point Program Hotel Reward Certificates (hereinafter "Reward Certificates").
- Members using the New Otani Club Point Program shall agree to the terms and conditions stipulated herein.
- The New Otani Club Point Program Terms and Conditions (hereinafter “Terms and Conditions”) are based on the New Otani Club Membership Regulations. Any matters not stipulated herein shall be subject to the stipulations of the New Otani Club Membership Regulations.
- Some services are not applicable for certain membership categories. Please contact the NOC Center office (hereinafter “Office”) for any inquiries regarding the NOC Point Program.
Article 2: Awarding of Points and Applicable Transactions
- New Otani shall award Points for accommodation at Group Hotels or dining at Designated restaurants/bars (set forth in the New Otani Club website) by a Member when the Member presents the New Otani Club Membership Card upon such use. However, the following cases shall be excluded.
1) Use of Associate Hotels in Japan and Group Hotels outside of Japan
2) Amounts of payment less than JPY 100
3) Charges relating to accommodation other than room charges or package/plan fees such as charges for mini bar, massages, etc., and pertaining tax and service charges
4) Charges relating to restaurants/bars other than food and beverage charges or package/plan fees such as charges for private rooms, flower decorations, etc., and pertaining tax and service charges
5) Payments for restaurant weddings
6) Payments for stays for which the reservation was made through travel companies or Internet channels other than the official website of Group Hotels
7) Payments not made by the Member him/herself
8) Payments made later than the day of use such as by bank transfers (except in cases otherwise approved by the relevant Group Hotel)
9) Payments made through master accounts of conventions, organizations, groups, etc.
10) Payments related to accommodation or restaurants/bars made collectively with banquet fees
11) Payments made with Reward Certificates
12) Payments made with tickets/coupons/vouchers such as invitation tickets, advance-sale tickets, meal coupons/vouchers, etc. (payment by cash vouchers issued by Group Hotels or credit card companies will be eligible for Points with some exceptions.)
13) Payments for uses prior to the date of admission to New Otani Club (admission procedure is deemed completed when the applicant receives his/her card and signs on the backside)
14) Payments made with points or benefits of organizations other than the New Otani Club, or stays under package plans or rates from such organizations
15) Payments for other products and services specified by New Otani - Points will be awarded for the amount of payment of the following items.
1) Accommodation: room charges, package/plan fees, and pertaining tax and service charges
2) Restaurants/bars: food and beverage charges, package/plan fees, and pertaining tax and service charges - Points, in principle, will be awarded when all of the following conditions are met.
1) Use of accommodation and designated restaurants/bars by the Member him/herself
2) When the New Otani Club Membership Card is presented at the front desk upon arrival (for accommodation) or making payment (for restaurants/bars)
3) When payment is made on the spot, directly to the Group Hotel by cash, credit card, or other means approved by the relevant Group Hotel
4) When the reservation is made by phone directly to the Group Hotel or through its official website - If the Member him/herself is staying, points will be awarded for up to two guest rooms (the Member's room and one other room specified by the Member) including the Member's own room only when payment is made directly to the Group Hotel by cash or credit card under one billing.
- Designated hotels and restaurants/bars are subject to change without prior notice.
Article 3: Posting of Awarded Points
- Points will be awarded for each payment of applicable transactions to one Member. Five Points will be awarded for every JPY 100 paid.
- Earned Points will be posted to the Member's account approximately 10 days after each payment.
Article 4: Calculation of Points
Points shall be calculated separately for each billing.
1) Points for accommodation shall be calculated separately for each night of stay.
2) Points for additional room charges shall be calculated separately with the package/plan fees, and not collectively.
3) Points for dining at designated restaurants/bars shall be calculated separately for each billing, even if there are multiple bills from the same restaurant on the same day.
4) Points for dining at designated restaurants/bars of which the payments are charged to guest rooms shall be calculated upon payment for the guest room. (Points will be calculated separately for accommodation and use of each restaurant/bar, even when restaurant/bar bills are charged to and paid collectively with accommodation charges.)
5) When two or more Members stay in the same room, only one Member will be eligible to receive Points for such stay.
Article 5: Duplication with Other Point Programs
- Points for the point programs of "New Otani Club Diners Card" and "New Otani Club VISA Card" as offered by respective credit card companies may also be earned for qualifying payments which are eligible for New Otani Club Points.
- Airline mileage for programs offered by respective airline carriers may also be earned for qualifying payments which are eligible for New Otani Club Points as stipulated by specific programs.
- Points may not be earned in conjunction with other point programs operated by respective Group Hotels.
Article 6: Retraction of Awarded Points
Awarded Points will be retracted for once paid amounts that are refunded, or required payments that are not made accordingly. In the case such Points are already redeemed, the amount corresponding to the otherwise retracted Points will be charged to the Member.
Article 7: Transfer/Aggregation of Points with Family Members
- Points may be transferred/aggregated only between either a Member and a family member of such Member, or family members of the same Member, (when there are several family members) and can be done by request to the office (hereinafter “Office”) from both such Member/Family Member.
- When transferring/aggregating Points, all Points retained by the Member/family member must be transferred/aggregated at once, and cannot be transferred/aggregated partially.
- This service is not applicable for certain membership categories.
Article 8: Transfer of Points to Non-family Members
Earned Points may not be transferred to Members other than family members of such Member, or be inherited, traded, or exchanged for cash.
Article 9: Validity Period and Expiration of Points
- Earned Points will be calculated annually on September 30 every year, and are valid for 2 years from that date. Points that are not redeemed by the end of the above validity period expire automatically, excluding the cases specified in the following clause.
- If the accumulated Points of a Member shall become negative due to retraction of Points as set out in Article 6 hereof or otherwise, such negative Point count shall be carried on after the normal validity period.
- Should an NOC member cancel its membership, a All earned Points forfeited, and such forfeited Points cannot be redeemed for Reward Certificates after the cancellation of such New Otani Club membership.
Article 10: Checking of Points
- Points can be checked by one of the following methods, based on request from the Member him/herself:
1) by phone to the Office,
2) at the "New Otani Club Counter" (Tokyo and Osaka) or front desks of the Group Hotels in Japan, or
3) by accessing the New Otani Club Point Program website through the Member's account. - Points will be reflected after such Points are posted to the Member's account, (approximately 10 days after each payment). as set out in section 2 of Article 3.
Article 11: Redemption of Points
- Every 5,000 Points earned can be redeemed as one Reward Certificate worth JPY 5,000, after such Points are posted to the Member's account (approximately 10 days after each payment), based on request from the Member him/herself.
- Requests for redemption of Points can be made by one of the following methods:
1) by phone to the Office,
2) at the "New Otani Club Counter" (Tokyo and Osaka) or front desks of the Group Hotels in Japan, or
3) by accessing the New Otani Club Point Program website through the Member's account. - Once the request for redemption has been accepted, it cannot be changed, modified or cancelled.
- Once the request for redemption of Points by a Member is made effectively and properly, New Otani will process such request and exchange the Points for Reward Certificate(s).
- New Otani is not liable for any tax or public dues that are imposed upon the amount corresponding to the Points redeemed as Reward Certificates.
Article 12: Issuing and Use of Reward Certificates
- Reward Certificates will be handed over in person at the hotel (New Otani Group Hotels within Japan) during the guest’s next stay. The request for redemption must be made 10 days prior to the arrival date.
- Reward Certificates may be used for payment for accommodation at New Otani Group Hotels within Japan or dining at designated restaurants/bars, until the valid date imprinted on each Reward Certificate, for the amount specified thereon.
- The following shall apply for the use of Reward Certificates.
1) Reward Certificates may be used for payments made on the day of use only. Reward Certificates are not valid as deposit or for payment at a later date.
2) Reward Certificates are not valid for purchasing cash vouchers, gift certificates or tickets of any kind.
3) The name, card number and valid date on the front side and registration number on the back side of the Reward Certificate must be correctly filled in.
4) Family members or friends of New Otani Club members are also eligible to use Reward Certificates.
5) The Reward Certificate is not a cash voucher. therefore Reward Certificates cannot be exchanged for cash.
6) No change will be given even if the total bill amounts to less than the amount imprinted on the Reward Certificate.
7) Reward Certificates once issued cannot be reissued for any reason, including loss or theft.
8) Buying and selling of Reward Certificates is prohibited.
9) Receipt will not be issued for the amount paid with Reward Certificates.
10) Points will not be awarded for the amount paid with Reward Certificates. - Designated hotels, restaurants and bars are subject to change.
Article 13: Change or Termination of New Otani Club Point Program
New Otani may terminate the services of New Otani Club Point Program in whole or in part at any time. In such cases, all entitlements related thereto will be forfeited unless otherwise explicitly acknowledged, notified, or announced to Members from New Otani.
Article 14: Disclaimer
- New Otani is not liable in any way for any damages the Member suffers due to delay of, changes in, or cancellation or termination of the services of New Otani Club Point Program, or otherwise in relation to the provided services thereof or failure to provide the services thereof.
- Members shall agree that all entitlements regarding the New Otani Club Point Program shall be forfeited if such Member applies to any one of the following. New Otani is not liable in any way for any loss or damage the Member suffers in such cases.
1) When the Member withdraws from New Otani Club or if the membership is cancelled.
2) When the Member fabricates or redeems Points by forgery, alteration, or any other unrighteous means.
Article 15: Change in the Terms and Conditions
- New Otani may change or make additions to the Terms and Conditions stipulated herein as necessary, without approval from Members. In Such changes or additions to the Terms and Conditions shall be announced by means of the official website or newsletter, and the latest version shall be posted the official websiteof the revised terms and conditions.
- When a Member uses the services stipulated herein after any change of the Terms and Conditions, it shall be deemed that such Member accepts and agrees to the new version of the Terms and Conditions.
Supplementary Provision
The Terms and Conditions stipulated herein are effective as of October 1, 2007.
